Michael P. McIlhinney is a partner at Toner Law Group, PLLC, a boutique real estate law firm based in Philadelphia that represents clients in matters such as Conservatorship, Zoning and Land Use, Tax Appeals, Construction Litigation, Code Enforcement Actions, Quiet Title Actions, Commercial Transactions, Municipal Claims, Condominium/Planned Community Law, and Appellate Practice. He and his firm have successfully represented both Act 135 Petitioners, Respondents, and Intervenors before the trial and appellate courts throughout the Commonwealth for over a decade.
Since 2015, Michael P. McIlhinney and his colleagues at Toner Law Group have been counsel in over 400 Act 135 petition actions. Michael was co-counsel with Paul J. Toner in achieving multiple published, appellate level decisions related to Act 135. Michael and Paul were counsel for the respondent/appellee in G & G Investors, LLC v. Phillips Simmons Real Estate Holdings, LLC, 183 A.3d 472 (Pa. Super. Ct. 2018), which is a leading case on Act 135 practice and procedure. Michael and Paul were also counsel for Petitioner in Philadelphia Community Development Coalition Inc. v. Philadelphia Redevelopment Authority, 298 A.3d 172 (Pa. Cmwlth. Ct. 2023), which held that Petitioner is entitled to an award of attorney fees and conservator’s fee where the abandoned building was demolished by a non-party municipality prior to an evidentiary hearing, and that post-filing demolition of the building does not moot the Act 135 action.
Michael has presented before Trade Organizations and Bar Associations on Act 135 and has participated in presentations before the National Bar Institute and the Pennsylvania Bar Association on a wide range of topics including Land Use Law, Zoning and Code Enforcement actions and the representation of Zoning Protestants.
After graduating from Villanova University Charles Widger School of Law, Michael was a litigation attorney in the Philadelphia office of large international law firms where he defended pharmaceutical and consumer product companies against mass tort claims, and represented life insurance carriers in the prosecution and defense of claims arising out of stranger originated life insurance. For the past 12 years, Michael’s practice has focused on zoning and land use matters, conservatorship, quiet title, code enforcement, and Orphans’ Court litigation. Michael was the 2022 Harris Ominsky Award winner which is presented annually to a pre-eminent real estate attorney in Philadelphia. Michael currently serves as the Treasure for the Executive Committee of the Philadelphia Bar Association’s Real Property Section.
